Below is current context. I get these notices weekly for music I have licensed. The content is immediately blocked. Warner Media is IP Police, Judge, and Jury.

SYNOPSIS: In March of 2020 I was contacted by Warner Media via their agent TrueCommerce.com claiming I was infringing on their “House Of The Dragon” registered trademark. There was and is no registered House Of The Dragon trademark as of June 2020. Many applications have been filed including by me, but there is no registered trademark.

Warner Media claimed I was cybersquatting on a domain name THEY owned, HouseOfTheDragon.com

This, even though they were well aware I bought it in October 2019 at a public, domain name auction, run by… TrueCommerce. Warner Media didn’t own it then. They don’t own it now.

After first producing a phony TrueCommerce purchase order for the domain name that didn’t even have the HBO/Warner name on it, Warner Media then claimed I only obtained it thru a mistake, a technical error, and they refused to even consider purchasing it from me.

Then Jeff turns around and accuses me, using all sorts of defamatory language, of being a Cybersquatter, which seems to be a bit of projection on his part.

ALL of the domain names above could have been purchased by HBO before I bought them. A couple of them I JUST BOUGHT.

It looks like this was a rushed, last minute announcement of a prequel whose title had only recently been thought about.

Warner Media and HBO didn’t performed even the first and most simple method to protect your alleged trademark. Registering domain names at a fraction of the cost it would take you to pursue legal action after someone bought them.

Simple due diligence didn’t occur. You, Warner Media, HBO, made zero effort to protect your alleged trademark until months after I bought the domain name. Isn’t that your duty? Why the incompetence?

Why is it Ryan Mellon, HBO trademark attorney, waited until October 29, 2019 to file a trademark application? That would seem incompetent unless EVERYONE WAS CAUGHT OFF GUARD BY THE ANNOUNCEMENT OF THE SHOW AND ITS NAME.

However, I don’t know how he could swear in a trademark application, there were no conflicting marks that might cause confusion, when he had to be aware of the previous applied for trademark by an Australian company. According to Paragraph 4(a) of the UDRP Policy, the UDRP Administrative Procedure is only available for disputes concerning an alleged abusive registration of a domain name; that is, which meet the following criteria:

(i) the domain name registered by the domain name registrant is identical or confusingly similar to a trademark or service mark in which the complainant (the person or entity bringing the complaint) has rights; AND

(ii) the domain name registrant has no rights or legitimate interests in respect of the domain name in question; AND

On October 29, 2019 HBO had no registered trademark.

As of March 28, 2020 HBO has two suspended trademark applications, one on hold, and several other pending. NO STATEMENT OF USE HAS BEEN FILED ON ANY OF THEM.

HouseOfTheDragon.com was purchased in a public domain auction. The domain was immediately put to use and is still being use to sell swim wear.

FUN FACT: The book the show is based on is not even titled House Of The Dragon, at least according to Casey Bloys President of HBO Programming, who himself didn’t appear to know the name of the prequel.

DAILEY PIKE SAYS: What does Game Of Thrones have to do with this? And what does it matter when I bought the domain name. HBO could have bought it before that. Should everyone wait to see if HBO wants something before they buy it? The show won’t even be on air until 2022.

As I see it, you have two options. The first is to negotiate with Mr. Reberry to sell the domain name. His company has agreed to re-purchase the domain name for HBO, given it’s error in reselling it to you after initially selling it to HBO. I am happy to assist you with those negotiations if you like. As I stated, HBO will not be paying for the domain name, as HBO did nothing wrong here. HBO purchased the domain name hours before its announcement of the Game of Thrones prequel by that name and received the below confirmation of its purchase. It is Huge Domains/TurnCommerce that will be funding the purchase price, and I am offering my help on behalf of HBO in negotiating that purchase price. This option of course offers you the guaranteed result of money, and the only question is how much.

Your second option is to refuse to sell the domain name to TurnCommerce. If you refuse to do that, HBO will be forced to file litigation to secure the return of the domain name. While I have no desire to debate with you the merits of our case, I think we can all agree that there are many facts that would support evidence of bad faith, not the least of which is the timing of your registration just hours after HBO’s announcement and your knowledge of that announcement. This option of course carries a high risk that you will receive no money for the domain name, not to mention the time and cost of litigation, which I hope we can both avoid.

Lawyer McMurtry that invoice proves nothing. You know that. Warner Bros name isn’t on that invoice. HBO’s name isn’t on that invoice.

Yet it’s hard to accept the truth when your paycheck depends on not accepting it.
