Below is current context. I get these notices weekly for music I have licensed. The content is immediately blocked. Warner Media is IP Police, Judge, and Jury.

SYNOPSIS: In March of 2020 I was contacted by Warner Media via their agent TrueCommerce.com claiming I was infringing on their “House Of The Dragon” registered trademark. There was and is no registered House Of The Dragon trademark as of June 2020. Many applications have been filed including by me, but there is no registered trademark.

Warner Media claimed I was cybersquatting on a domain name THEY owned, HouseOfTheDragon.com

This, even though they were well aware I bought it in October 2019 at a public, domain name auction, run by… TrueCommerce. Warner Media didn’t own it then. They don’t own it now.

After first producing a phony TrueCommerce purchase order for the domain name that didn’t even have the HBO/Warner name on it, Warner Media then claimed I only obtained it thru a mistake, a technical error, and they refused to even consider purchasing it from me.

ALL of the domain names above could have been purchased by HBO before I bought them. A couple of them I JUST BOUGHT.

It looks like this was a rushed, last minute announcement of a prequel whose title had only recently been thought about.

Warner Media and HBO didn’t performed even the first and most simple method to protect your alleged trademark. Registering domain names at a fraction of the cost it would take you to pursue legal action after someone bought them.

Simple due diligence didn’t occur. You, Warner Media, HBO, made zero effort to protect your alleged trademark until months after I bought the domain name. Isn’t that your duty? Why the incompetence?

Why is it Ryan Mellon, HBO trademark attorney, waited until October 29, 2019 to file a trademark application? That would seem incompetent unless EVERYONE WAS CAUGHT OFF GUARD BY THE ANNOUNCEMENT OF THE SHOW AND ITS NAME.

As of March 28, 2020 HBO has two suspended trademark applications, one on hold, and several other pending. NO STATEMENT OF USE HAS BEEN FILED ON ANY OF THEM.

HouseOfTheDragon.com was purchased in a public domain auction. The domain was immediately put to use and is still being use to sell swim wear.

FUN FACT: The book the show is based on is not even titled House Of The Dragon, at least according to Casey Bloys President of HBO Programming, who himself didn’t appear to know the name of the prequel.

  • Your actions violate the Internet Corporation for Assigned Names and Numbers’ (ICANN) Uniform Domain-Name Dispute-Resolution Policy (UDRP), specifically UDRP Policy, 4(a)(iii), and 4(b)(i) and (iv).

DAILEY PIKE SAYS: Yes, a Notice Of Allowance has been issued for several of HBO’s Intent To Use (b) applications but only on March 10, 2020. TO MY KNOWLEDGE NO STATEMENT OF USE HAS BEEN FILED. Even after a Statement of Use has been filed it’s several months before it registers. So as of October 29, 2019 and March 10th, 2020, HBO had zero registered trademarks.

DAILEY PIKE SAYS: I bought the domain name in October and began using it in early November for my registered trademark Dragon Fashion® selling swimwear at at a major show at the Anaheim Convention Center. Watch the ad I ran below. It’s one of many.

  • You purchased the HouseOfTheDragon.com domain only hours after HBO announced the prequel to the popular show Game of Thrones.

DAILEY PIKE SAYS: What does Game Of Thrones have to do with this? And what does it matter when I bought the domain name. HBO could have bought it before that. Should everyone wait to see if HBO wants something before they buy it? The show won’t even be on air until 2022.

House of the Dragon, HBO’s straight-to-series prequel to Game Of Thrones, is on track for a 2022 debut, HBO President of Programming Casey Bloys said in an interview with Deadline during TCA.”

“My guess is sometime in 2022,” he said about when the series will premiere, stressing that it is too early to be more specific than that.”

  • You have expressly acknowledged to a GoDaddy domain broker that you are only willing to sell the domain if HBO was the buyer — because they have a new show coming out and the domain would be the most valuable to HBO — and nobody else. You also indicated you did not want to discuss selling the domain to anyone else — unless it was HBO that was inquiring. You further stated that you were willing to sell the domain in the amount of $50,000 to HBO. All of these statements prove your intent to abuse HBO’s Intellectual Property and try to profit off of their rights in the term.

  • You are taking advantage of HBO’s copyrighted work by choosing to use dragons and stock footage that resembles HBO’s Game of Thrones characters on the current site, all of which has been screenshotted during HBO’s investigation into this matter. This further corroborates your intent to infringe on HBO’s marks in your quest to profit off of their goodwill.

DAILEY PIKE SAYS: This has nothing to do with Game Of Thrones. No trademark, no goodwill. #Markfraud

You will want to review 15 U.S. Code § 1125(d) as your actions demonstrate a bad faith intent to profit from HBO’s trademark. We strongly advise you to reach out to an Intellectual Property Attorney and seek your own legal opinion on this matter.

DAILEY PIKE SAYS: I bought the domain on October 29th. By November 4 it wasn’t transfered, I was tired of waiting and asked to CANCEL THE SALE. I was refused.

Let me repeat, I tried to cancel the sale.

Well first off as I indicated It’s Mr. Pike and B, nothing else in the email was true.

Yet, you Lawyer McMurtry blithely adopted the non lawyer’s threatening email. The one that claimed non-existent trademarks on Warner Media’s behalf. #Markfraud

And you Lawyer McMurtry began the FALSE NARRATIVE that HBO registered the domain name before I did. They didn’t. At least according to ICANN.

To the extent that it matters, you should note that HBO did in fact register this domain name before you did and it is only due to a transmission error that you were able to purchase it.

We would like to resolve this issue amicably. To that end, our preference would be that you are able to come to a reasonable financial arrangement with Mr. Reberry.

This is what we have in our possession that demonstrates proof of HBO’s prior purchase of the domain name.

As I see it, you have two options. The first is to negotiate with Mr. Reberry to sell the domain name. His company has agreed to re-purchase the domain name for HBO, given it’s error in reselling it to you after initially selling it to HBO. I am happy to assist you with those negotiations if you like. As I stated, HBO will not be paying for the domain name, as HBO did nothing wrong here. HBO purchased the domain name hours before its announcement of the Game of Thrones prequel by that name and received the below confirmation of its purchase. It is Huge Domains/TurnCommerce that will be funding the purchase price, and I am offering my help on behalf of HBO in negotiating that purchase price. This option of course offers you the guaranteed result of money, and the only question is how much.

Your second option is to refuse to sell the domain name to TurnCommerce. If you refuse to do that, HBO will be forced to file litigation to secure the return of the domain name. While I have no desire to debate with you the merits of our case, I think we can all agree that there are many facts that would support evidence of bad faith, not the least of which is the timing of your registration just hours after HBO’s announcement and your knowledge of that announcement. This option of course carries a high risk that you will receive no money for the domain name, not to mention the time and cost of litigation, which I hope we can both avoid.

Please let me know which of the two above options you wish to pursue.

Lawyer McMurtry that invoice proves nothing. You know that. Warner Bros name isn’t on that invoice. HBO’s name isn’t on that invoice.

Yet it’s hard to accept the truth when your paycheck depends on not accepting it.

So step up Lawyer McMurtry. I’ve been using the domain since I bought it. I bought a domain name legally and legitimately. I started using it in early November 2019. I bought the domain name to use. I have several Dragon trademarks, unlike Warner and HBO.

Your accusations of infringement and cyber squatting were not made until March 2020. And even then YOU didn’t make them yourself, you made them thru an inept surrogate.

Why did it take FOUR MONTHS? How important could that domain be to HBO. How could you Lawyer McMurtry not be on top of this?

Was Jeff Reberry of Huge Domains just stalling, afraid to tell you because he screwed up, and as a result might lose his biggest client? That would make the most sense. Yet you blame ME.
